Terms of Service

1. Agreement to Terms

By accessing or using the services of Brisbane Website Designs, a division of Infodots Digital, LLC, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

2. Services

We provide website design and development services including but not limited to:

• Custom website design and development
• Search engine optimisation (SEO)
• Website maintenance
• Domain registration assistance
• Web hosting setup
• Content creation

3. Pricing and Payment

Our packages are priced as one-time payments in Australian Dollars (AUD). Payment terms:

• 100% upfront payment is required to book your project slot and commence work. This secures your position in our queue and allows us to dedicate the necessary resources to your project.
• We accept local bank transfer to our Australian business account, as well as all major credit and debit cards (Visa, Mastercard, American Express).
• Prices are subject to change without notice for new projects.
• Additional features or revisions beyond the agreed scope may incur extra charges, which will be communicated and approved before proceeding.
• No refunds are available once work has commenced, as resources have been allocated to your project.

4. Project Timeline

Delivery timelines are estimates based on typical project complexity. Delays may occur due to:

• Late provision of content or materials by the client
• Scope changes requested by the client
• Extended revision rounds beyond included allowance
• Third-party service delays

5. Client Responsibilities

Clients are responsible for:

• Providing accurate and timely content, images, and information
• Reviewing and approving designs within reasonable timeframes
• Ensuring provided content does not infringe on third-party rights
• Maintaining login credentials and domain registrations after handover

6. Intellectual Property

Upon full payment, you own 100% of the custom code and design created specifically for your project. We retain the right to:

• Display the work in our portfolio
• Use third-party tools and frameworks that remain under their respective licences
• Reuse general techniques and methods in other projects

7. Maintenance Services

The 1-year free maintenance period includes security updates, bug fixes, and minor content changes. It does not include:

• New feature development
• Major design changes
• Third-party integration issues
• Issues caused by client modifications

After the free period, optional maintenance plans are available starting at AU$79/month.

8. Limitation of Liability

To the maximum extent permitted by law, Brisbane Website Designs and Infodots Digital, LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services.

9. Refund Policy

Due to our 100% upfront payment model and the immediate allocation of resources upon booking:

• Before work begins (within 24 hours of payment): Full refund available upon request.
• After work has commenced: No refunds are available as resources, time, and expertise have been dedicated to your project.
• We encourage clients to thoroughly review our packages and discuss requirements before making payment to ensure alignment.

10. Governing Law

These terms shall be governed by and construed in accordance with the laws of Queensland, Australia, without regard to its conflict of law provisions.
